Accepting these terms

These terms are an agreement between you and In Its Places, a professional organizing business owned and run by Leanna Mortenson. By using initsplaces.com, you accept them. If you don't accept them, please don't use the site. Nothing here is meant to be a trap, and if any of it seems unfair, call and say so.

What these terms cover

These terms cover the website: reading it, looking at the gallery, and sending an inquiry through it.

They aren't the agreement for the organizing work. When you hire us, you get a written proposal and an agreement to sign, and that document is what governs the job: what's included, what it costs, how it's scheduled, and what happens if either of us needs to cancel or reschedule. If anything on this page ever appears to conflict with a signed agreement, the signed agreement wins for everything to do with the work.

Who can use this site

You need to be 18 or older to send us an inquiry or hire us. If you're contacting us on behalf of somebody else, such as a parent or a client of your own, you're confirming that you're allowed to.

Using the site

You're welcome to read this site, print it, share links to it, and use it to get in touch. What you can't do is:

• break into it, or try to, including probing it for weaknesses;
• interfere with it or overload it deliberately;
• use it to send anything unlawful, threatening or deceptive;
• impersonate us, or use our name or logo to suggest we endorse something;
• republish our photographs or copy as though they were yours.

Automated access is allowed if it follows our robots.txt. Search engine crawlers and AI assistants are welcome here, and this site names several of them explicitly in robots.txt so they can index it and quote it. What that file asks a crawler not to fetch, please don't fetch, and please don't hammer the server.

Our content

The words, the photographs, the logo and the design on this site belong to In Its Places, and they're protected by copyright and trademark law. You may read them and link to them. Copying them onto another site, using them in advertising, or feeding a photograph into something that resells it as its own needs our written permission first, which is usually a quick yes if you ask.

The name In Its Places and our logo are our marks. Please don't use them for anything that could suggest we're connected to your business when we're not.

Photographs

Every before and after photograph on this site is from a real home, published with the homeowner's permission, and edited to remove what would identify them. We describe a project by the type of room and sometimes the town, and never by a street address.

If you're a client and you want a photograph of your home taken down, tell us and we'll remove it from this site and from our social media. How that works is in the Privacy Policy.

What you send us

When you fill in the inquiry form or write to us, please keep what you send accurate, and please keep it to what we need in order to help. The form is for arranging a conversation about your home, so don't send account numbers, passwords, medical details or anything else you'd rather nobody held.

We use what you send to answer you, quote the work and do the job. We don't claim ownership of it. If you send us a photograph of a room so we can quote, you're giving us permission to use it for that purpose, and we won't publish it without asking you separately.

Consultations and estimates

The consultation is free, it takes about an hour, and there's nothing to sign at the end of it. Any estimate that comes out of it is based on what we saw and what you told us. If the job turns out to be materially different once we start, we'll tell you before we carry on, not after.

Descriptions of our services on this site are a summary, not an offer with fixed terms. Prices, timing and scope are what the written proposal says.

Payments

We accept electronic payments. Invoices are sent through HoneyBook, and you pay them by card or bank transfer on HoneyBook's own secure pages.

We don't store your card or bank details. Not on this website's servers and not on our own computers. That information goes to HoneyBook and the payment processors they use, who are responsible for handling it securely. What we see is whether an invoice was paid, when, and by what method.

Deposits, payment schedules, late payments, cancellations and refunds are covered by the agreement you sign for the work, and not by this page.

Third party services

Parts of this site are provided by other companies: the inquiry form and the client portal are HoneyBook's, and we link out to Instagram and Facebook. When you use one of those you're also agreeing to that company's terms, and we don't control their service or their availability. If their form is down, the phone number at the bottom of every page still works.

What we do not promise

We keep this site accurate and current, but we can't promise it's free of errors, always available, or exactly right about a detail that changed yesterday. The site is provided as it is. To the extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement for the website.

Nothing on this site is legal, financial, medical or real estate advice. The gallery shows work done in other people's homes, and how a room of yours turns out depends on your home, your belongings and the decisions you make about them.

Limitation of liability

This section is about the website only. Our responsibility for the organizing work itself, including anything that happens in your home, is covered by the agreement you sign for that work, and nothing on this page reduces it.

To the extent the law allows, In Its Places isn't liable for indirect, incidental or consequential damages arising out of your use of this website, and our total liability for any claim relating to the website is limited to one hundred dollars.

Some things can't be limited, and we're not trying to. Nothing in these terms limits our liability for fraud, for willful misconduct, for gross negligence, for personal injury caused by our negligence, or for anything else that California law says cannot be limited by contract, including under Civil Code section 1668.

Indemnification

If you use this site in a way these terms prohibit and that causes us a claim, a loss or a legal bill, you agree to cover it. This doesn't apply to anything caused by us.

Privacy

What we collect and what we do with it is set out in the Privacy Policy, which is part of these terms by reference. It also explains the privacy rights you have under California law.

Changes

We may change this site or these terms. When we change the terms we'll update the date at the top of this page, and the version published here is the one that applies. If you keep using the site after a change, you've accepted it. We may also add, alter or retire parts of the site without notice.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute that has to go to court goes to the state or federal courts serving Ventura County, California, and we both agree to those courts.

Before it gets that far, please call (805) 205-3198 or email leanna@initsplaces.com. This is a one person business in a community where reputation is everything, and almost anything can be sorted out in a conversation.

General terms

• If a court finds part of these terms unenforceable, the rest stays in force and that part is narrowed only as far as it has to be.
• If we don't enforce something right away, we haven't given up the right to enforce it later.
• These terms, the Privacy Policy, and any agreement you've signed for the work are the whole agreement between us about this site.
• You can't transfer your rights under these terms to somebody else. We can transfer ours if the business is sold.
• Headings are there to help you find things, and don't change what a section means.
